RDP incorrectly using compatible mode on both Windows Server 2012 R2 and Server Next


we have vms running windows 8.1 , other vms running windows 10 preview.  the environment inside vms gpu accelerated, transmission on network uses ws 2008 r2 fallback mode, shown event logs on remote desktop virtualisation host.  h264 encoding disabled, unless try connect freerdp, in case works fine.

this happens under both 2012 r2 , upgraded windows server 10 box.  i have tried machines domained, non-domained, neither works.  firewall off on client pc, , on vm.  i've extensively reviewed group policies , tried many options in there.  nothing has helped.  anyone got ideas?  avenues investigate?

machine i7 64gb of ram , 2 amd r7 260 gpus available hyper-v.
